The terms that govern your use of the Clubwater platform

These Terms of Service ("Terms") govern your use of the Clubwater platform, including the website at clubwater.co.uk, the angler wallet application at app.clubwater.co.uk, and the club administration portal ("the Platform").

By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. The Clubwater service

Clubwater provides a digital membership wallet platform for UK angling clubs and their members. The Platform enables:

2. Accounts and registration

Eligibility

You must be at least 13 years old to create a Clubwater account. If you are under 18, you confirm that you have parental or guardian consent to use the Platform.

Account security

You are responsible for maintaining the security of your account credentials. You must not share your password with anyone. You must notify us immediately at hello@clubwater.co.uk if you believe your account has been compromised.

Accurate information

You agree to provide accurate and complete information when registering and to keep your account details up to date.


3. Club administrators

If you register a fishing club on Clubwater, you confirm that:

Clubwater acts as a data processor for club member data. The club remains the data controller and is responsible for compliance with data protection obligations in relation to its members.


4. Payments and fees

Club fees

Clubwater is free for fishing clubs. There is no monthly subscription, setup fee, or transaction fee charged to the club. Clubs receive 100% of their membership price on every transaction.

Digital service fee

When an angler purchases a membership through Clubwater, a digital service fee of 5% is added to the membership price at checkout. This fee is paid by the angler and covers all card processing costs and platform fees. The club's membership income is never reduced.

Payment processing

Payments are processed by Stripe. By using the payment features of the Platform, you agree to Stripe's terms of service, available at stripe.com/legal. Clubwater does not store payment card details.

Refunds

Refund requests for membership payments should be directed to the relevant fishing club. Clubs process refunds directly through their Stripe dashboard. Clubwater does not handle refund requests on behalf of clubs.


5. Digital permits and QR verification

Digital permits issued through Clubwater are the property of the issuing club. They are verified in real time against the Clubwater database at the moment of scanning. Permits that have expired or been suspended will return an invalid result when scanned.

Anglers must not attempt to share, copy, or transfer their digital permits to other individuals. Each permit is issued to a named individual and is non-transferable.

Clubwater cannot guarantee uninterrupted access to permit verification in areas with no internet connectivity. Anglers are advised to ensure their permit is visible in their wallet before travelling to waters with poor signal.

You agree not to use the Platform to:

7. Intellectual property

All content on the Clubwater Platform, including but not limited to the design, code, text, graphics, and logos, is owned by or licensed to Clubwater and is protected by applicable intellectual property laws.

Club administrators retain ownership of the content they upload to the Platform, including club rules, fixture lists, water descriptions, and contact information. By uploading content, you grant Clubwater a non-exclusive licence to store and display that content for the purpose of operating the Platform.


8. Limitation of liability

To the fullest extent permitted by law, Clubwater shall not be liable for:

Clubwater's total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the total fees paid by you to Clubwater in the three months preceding the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.


9. Termination

By you

You may close your account at any time by contacting us at hello@clubwater.co.uk. Clubs may leave the Platform at any time and export their member data via CSV. There is no contract or minimum term.

By us

We reserve the right to suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or use the Platform in a way that causes harm to other users or to Clubwater.

Effect of termination

On termination of a club's account, digital permits previously issued to that club's members will no longer be verifiable through the Platform. Anglers' wallet accounts remain active and may continue to be used for other clubs.


10. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "last updated" date at the top of this page. For significant changes, we will notify registered users by email with at least 14 days notice before the changes take effect.

Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.


11. Governing law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.
